<p class="wp-block-paragraph"><strong>&#8220;If I&#8217;m replacing an existing bedroom window, does the new window have to meet today&#8217;s egress code?&#8221;</strong></p>



<p class="wp-block-paragraph">It&#8217;s a fair question because there are a lot of opinions on the subject.</p>



<p class="wp-block-paragraph">Some people immediately assume every replacement window must meet today&#8217;s emergency escape and rescue opening requirements.</p>



<p class="wp-block-paragraph">Others believe any existing bedroom window can simply be replaced with another window the same size.</p>



<p class="wp-block-paragraph">Neither answer starts in the right place.</p>



<p class="wp-block-paragraph">The first question isn&#8217;t how large the replacement window is.</p>



<p class="wp-block-paragraph">The first question is:</p>



<p class="wp-block-paragraph"><strong>Which IRC section applies to this project?</strong></p>



<p class="wp-block-paragraph">If you&#8217;re simply replacing an existing emergency escape and rescue window, the code provides a specific path that many people overlook.</p>



<p class="wp-block-paragraph">This article focuses specifically on <strong>replacement bedroom windows</strong> under IRC Section R310.5. <h1 class="wp-block-heading">Start With the Scope of the Project</h1>



<p class="wp-block-paragraph">This article addresses one specific situation:</p>



<p class="wp-block-paragraph"><strong>Replacing an existing emergency escape and rescue window.</strong></p>



<p class="wp-block-paragraph">It does <strong>not</strong> address:</p>



<ul class="wp-block-list">
<li class="">creating a new sleeping room,</li>



<li class="">converting an existing room into a bedroom,</li>



<li class="">constructing a dwelling addition,</li>



<li class="">or a change of occupancy.</li>
</ul>



<p class="wp-block-paragraph">Each of those situations is governed by different sections of the International Residential Code.</p>



<p class="wp-block-paragraph">That&#8217;s the first step in any code analysis.</p>



<p class="wp-block-paragraph">Determine the scope of the work before determining the requirements.</p>

<h1 class="wp-block-heading">When Does IRC Section R310.5 Apply?</h1>



<p class="wp-block-paragraph">Section R310.5 applies only when all of the following conditions are met.</p>



<h2 class="wp-block-heading">The Replacement Window Must Be the Largest Standard-Size Window That Fits</h2>



<p class="wp-block-paragraph">The replacement window must be the manufacturer&#8217;s largest standard-size window that will fit within:</p>



<ul class="wp-block-list">
<li class="">the existing frame, or</li>



<li class="">the existing rough opening.</li>
</ul>



<p class="wp-block-paragraph">The code does not require enlarging the rough opening.</p>



<p class="wp-block-paragraph">It also does not require a custom-manufactured window.</p>



<p class="wp-block-paragraph">However, selecting a smaller replacement window simply because it is convenient does not satisfy this requirement.</p>

<h2 class="wp-block-heading">The Operating Style Must Qualify</h2>



<p class="wp-block-paragraph">The replacement window must be either:</p>



<ul class="wp-block-list">
<li class="">the same operating style as the existing window,</li>
</ul>



<p class="wp-block-paragraph">or</p>



<ul class="wp-block-list">
<li class="">another operating style that provides an equal or greater window opening area than the existing window.</li>
</ul>

<h2 class="wp-block-heading">The Work Cannot Be Part of a Change of Occupancy</h2>



<p class="wp-block-paragraph">If the replacement is part of a change of occupancy, Section R310.5 does not apply.</p>

<h1 class="wp-block-heading">What Does the Replacement Window Exception Actually Change?</h1>



<p class="wp-block-paragraph">This is where most of the confusion begins.</p>



<p class="wp-block-paragraph">A qualifying replacement window under Section R310.5 is exempt from Section R310.2.</p>



<p class="wp-block-paragraph">That means the replacement window does <strong>not necessarily</strong> have to comply with the normal emergency escape and rescue opening requirements for:</p>



<ul class="wp-block-list">
<li class="">minimum net clear opening area,</li>



<li class="">minimum net clear opening height,</li>



<li class="">minimum net clear opening width,</li>



<li class="">maximum height from the floor to the bottom of the clear opening,</li>



<li class="">and the requirement that those dimensions result from the normal operation of the window.</li>
</ul>



<p class="wp-block-paragraph">Those are the standard requirements for emergency escape and rescue openings.</p>



<p class="wp-block-paragraph">Section R310.5 provides a different compliance path when its conditions are satisfied.</p>

<h1 class="wp-block-heading">Above-Grade and Grade-Floor Replacement Windows</h1>



<p class="wp-block-paragraph">For most above-grade and grade-floor replacement windows, the analysis is fairly straightforward.</p>



<p class="wp-block-paragraph">If:</p>



<ul class="wp-block-list">
<li class="">you&#8217;re replacing an existing emergency escape and rescue window,</li>



<li class="">Section R310.5 applies,</li>



<li class="">and every condition in that section is satisfied,</li>
</ul>



<p class="wp-block-paragraph">the replacement window may qualify without enlarging the existing opening to meet today&#8217;s standard emergency escape and rescue opening dimensions.</p>



<p class="wp-block-paragraph">For many projects, that&#8217;s where the analysis ends.</p>

<h1 class="wp-block-heading">Basement Replacement Windows Require One Additional Code Analysis</h1>

<p class="wp-block-paragraph">Basement replacement windows often involve one additional question.</p>



<p class="wp-block-paragraph"><strong>Is the emergency escape and rescue opening located below adjacent grade?</strong></p>



<p class="wp-block-paragraph">If it is, Section R310.4 also becomes part of the analysis because the opening may require an area well.</p>



<p class="wp-block-paragraph">This is where some people incorrectly assume the replacement-window exception eliminates every requirement associated with the basement opening.</p>



<p class="wp-block-paragraph">It doesn&#8217;t.</p>



<p class="wp-block-paragraph">Section R310.5 exempts qualifying replacement windows from Sections R310.2 and R310.4.4.</p>



<p class="wp-block-paragraph">It does <strong>not</strong> exempt every other provision found in Section R310.4.</p>



<p class="wp-block-paragraph">If the emergency escape and rescue opening is below adjacent grade, the applicable area-well provisions should also be evaluated based on the scope of the work.</p>



<hr class="wp-block-separator has-alpha-channel-opacity"/>



<h1 class="wp-block-heading">Don&#8217;t Forget the Area Well</h1>



<p class="wp-block-paragraph">Where an emergency escape and rescue opening is below adjacent grade, Section R310.4 establishes separate requirements for area wells.</p>



<p class="wp-block-paragraph">Depending on the project, those provisions may include:</p>



<ul class="wp-block-list">
<li class="">minimum area-well dimensions,</li>



<li class="">allowing the window to fully open,</li>



<li class="">ladders or steps where required, and</li>



<li class="">drainage.</li>
</ul>



<p class="wp-block-paragraph">These requirements are evaluated separately from the replacement-window provisions in Section R310.5.</p>



<hr class="wp-block-separator has-alpha-channel-opacity"/>



<h1 class="wp-block-heading">A Brief Note About Section R310.4.4</h1>



<p class="wp-block-paragraph">Section R310.5 also exempts qualifying replacement windows from Section R310.4.4.</p>



<p class="wp-block-paragraph">For most replacement-window projects, this is a secondary consideration because Section R310.4.4 addresses bars, grilles, covers, screens, and similar devices installed over emergency escape and rescue openings or their area wells.</p>



<p class="wp-block-paragraph">This exemption should not be interpreted as allowing a device that interferes with emergency escape or rescue.</p>



<p class="wp-block-paragraph">Section R310.1.1 still requires emergency escape and rescue openings to be operational from inside the room without the use of keys, tools, or special knowledge.</p>

<h1 class="wp-block-heading">Don&#8217;t Confuse These Four Different Projects</h1>

<p class="wp-block-paragraph">One of the most common mistakes is assuming every bedroom window project follows the same rules.</p>

<p class="wp-block-paragraph">A replacement window, a new basement bedroom, a dwelling addition, and a change of occupancy each have their own code analysis.</p>

<li class="">Is it the same operating style, or does the new operating style provide an equal or greater window opening area?</li>



<li class="">Is the project part of a change of occupancy?</li>



<li class="">Is the emergency escape and rescue opening below adjacent grade?</li>



<li class="">Does an area well also need to be evaluated?</li>



<li class="">Have state or local amendments modified these requirements?</li>



<li class="">Has the Authority Having Jurisdiction (AHJ) adopted an interpretation that affects this project?</li>

<p class="wp-block-paragraph">This article discusses the <strong>2021 International Residential Code (IRC).</strong></p>



<p class="wp-block-paragraph">If your jurisdiction has adopted the <strong>2024 IRC</strong>, these provisions have been renumbered into <strong>Section R319</strong>, but the replacement-window concepts remain substantially the same.</p>



<p class="wp-block-paragraph">Always verify:</p>

<li class="">the code edition adopted by your jurisdiction,</li>



<li class="">state amendments,</li>



<li class="">local amendments, and</li>



<li class="">any requirements or interpretations of the Authority Having Jurisdiction (AHJ).</li>

<p class="wp-block-paragraph">Actually, maybe you can.</p>



<p class="wp-block-paragraph">I&#8217;ve seen this come up during plan reviews, inspections, and conversations with homeowners more times than I can count. Someone notices a basement emergency escape window under a proposed deck and immediately says the deck isn&#8217;t allowed.</p>



<p class="wp-block-paragraph">That&#8217;s not what the IRC says.</p>



<p class="wp-block-paragraph">The code doesn&#8217;t prohibit decks in front of emergency escape and rescue openings. Instead, it establishes minimum conditions that must still be met when the opening is located beneath a deck, porch, or cantilever.</p>



<p class="wp-block-paragraph">So, can you build a deck in front of an egress window? Yes—but only if the emergency escape and rescue opening continues to meet the minimum requirements of the IRC.</p>

<h1 class="wp-block-heading">What the Code Says</h1>



<p class="wp-block-paragraph">The governing section in the <strong>2021 International Residential Code</strong> is <strong>Section R310.2.4</strong>, <em>Emergency Escape and Rescue Openings Under Decks, Porches and Cantilevers.</em></p>



<p class="wp-block-paragraph">Before jumping to that section, it&#8217;s helpful to read the surrounding provisions.</p>



<p class="wp-block-paragraph">Section <strong>R310.1</strong> tells us <strong>when</strong> emergency escape and rescue openings are required. Basements, habitable attics, and every sleeping room generally require at least one operable emergency escape and rescue opening. Those openings must lead directly to a public way or to a yard or court meeting the requirements of the section.</p>



<p class="wp-block-paragraph">Once we&#8217;ve determined that an emergency escape and rescue opening is required, Section <strong>R310.2.4</strong> tells us what happens if that opening is located beneath a deck, porch, or cantilever.</p>



<p class="wp-block-paragraph">The opening must:</p>



<ul class="wp-block-list">
<li class="">Remain fully openable.</li>



<li class="">Provide a path at least <strong>36 inches high</strong>.</li>



<li class="">Provide a path at least <strong>36 inches wide</strong>.</li>



<li class="">Lead to a yard or court.</li>
</ul>



<p class="wp-block-paragraph">The <strong>2024 IRC</strong> renumbered this section to <strong>R319.2.4</strong>, but the requirement itself did not change.</p>

<h1 class="wp-block-heading">Why the Confusion Happens</h1>



<p class="wp-block-paragraph">Here&#8217;s where people get tripped up.</p>



<p class="wp-block-paragraph">Many people stop as soon as they see a deck in front of the window and assume the project violates the code.</p>



<p class="wp-block-paragraph">The IRC never says that.</p>



<p class="wp-block-paragraph">Instead, it recognizes that emergency escape and rescue openings may be located beneath decks, porches, and cantilevers. If that condition exists, the code simply requires that the opening remain usable and that a compliant path be maintained.</p>



<p class="wp-block-paragraph">The trigger isn&#8217;t <strong>&#8220;there is a deck.&#8221;</strong></p>



<p class="wp-block-paragraph">The trigger is <strong>an emergency escape and rescue opening installed beneath a deck, porch, or cantilever.</strong></p>



<p class="wp-block-paragraph">Once that condition exists, Section R310.2.4 applies.</p>

<h1 class="wp-block-heading">Applying the Section</h1>



<p class="wp-block-paragraph">This is the same thought process an inspector would follow.</p>



<h3 class="wp-block-heading">Step 1 – Is an emergency escape and rescue opening required?</h3>



<p class="wp-block-paragraph">Start with Section R310.1.</p>



<p class="wp-block-paragraph">If the basement or sleeping room is required to have an emergency escape and rescue opening, continue the analysis.</p>



<p class="wp-block-paragraph">If the opening isn&#8217;t required because of an applicable exception, Section R310.2.4 generally won&#8217;t come into play.</p>



<p class="wp-block-paragraph">Applicability always comes first.</p>

<h3 class="wp-block-heading">Step 2 – Is the opening located beneath a deck, porch, or cantilever?</h3>



<p class="wp-block-paragraph">If not, this section doesn&#8217;t apply.</p>



<p class="wp-block-paragraph">If it is, continue.</p>

<h3 class="wp-block-heading">Step 3 – Can the window fully open?</h3>



<p class="wp-block-paragraph">The code specifically requires the opening to be <strong>fully openable</strong>.</p>



<p class="wp-block-paragraph">That means deck framing, beams, stair construction, skirting, utilities, or other construction cannot prevent the window from opening as intended.</p>

<h3 class="wp-block-heading">Step 4 – Is the required path maintained?</h3>



<p class="wp-block-paragraph">The code requires a path at least:</p>



<ul class="wp-block-list">
<li class=""><strong>36 inches high</strong>, and</li>



<li class=""><strong>36 inches wide</strong></li>
</ul>



<p class="wp-block-paragraph">That path must extend from the emergency escape and rescue opening to the required yard or court described in Section R310.1.</p>



<p class="wp-block-paragraph">Notice what the code doesn&#8217;t say.</p>



<p class="wp-block-paragraph">It doesn&#8217;t require removing the deck.</p>



<p class="wp-block-paragraph">It doesn&#8217;t prohibit construction over the window.</p>



<p class="wp-block-paragraph">It simply establishes the minimum dimensions for the escape path beneath the structure.</p>

<h1 class="wp-block-heading">Reading the Related Sections Together</h1>



<p class="wp-block-paragraph">One reason this topic causes confusion is that people often read only Section R310.2.4.</p>



<p class="wp-block-paragraph">The surrounding sections matter.</p>



<p class="wp-block-paragraph">Section <strong>R310.1</strong> establishes where emergency escape and rescue openings are required and states that they must extend from the emergency escape and rescue opening to the required yard or court described in Section R310.1.</p>



<p class="wp-block-paragraph">Exception 3 to Section <strong>R310.1</strong> also recognizes that the yard does not always have to open directly to a public way, provided there is an <strong>unobstructed path</strong> to the public way that is at least <strong>36 inches wide</strong>.</p>



<p class="wp-block-paragraph">Reading these sections together gives a more complete picture of how the code intends the escape route to function.</p>

<h1 class="wp-block-heading">Common Field Mistakes</h1>



<p class="wp-block-paragraph">Here are several mistakes I commonly see.</p>



<h3 class="wp-block-heading">Deck Built Too Low</h3>



<p class="wp-block-paragraph">The window technically opens, but not fully.</p>



<p class="wp-block-paragraph">If the sash contacts framing or other construction before reaching its normal fully open position, the requirement is not met.</p>

<h3 class="wp-block-heading">Stairs Installed Directly in Front of the Window</h3>



<p class="wp-block-paragraph">The deck itself isn&#8217;t necessarily the problem.</p>



<p class="wp-block-paragraph">The stair stringers or stair landing may obstruct the required escape path.</p>

<h3 class="wp-block-heading">Decorative Skirting Added Later</h3>



<p class="wp-block-paragraph">This one surprises homeowners.</p>



<p class="wp-block-paragraph">The deck may have passed inspection originally.</p>



<p class="wp-block-paragraph">Months later, lattice, storage walls, or decorative skirting are installed beneath the deck, reducing or blocking the required path.</p>

<h3 class="wp-block-heading">Storage Under the Deck</h3>



<p class="wp-block-paragraph">I&#8217;ve seen lawn equipment, bicycles, firewood, storage cabinets, and shelving placed directly in front of emergency escape windows.</p>



<p class="wp-block-paragraph">The code requires a usable path—not one that&#8217;s blocked by stored materials.</p>

<li class="">Can the window fully open?</li>



<li class="">Is there still a clear path at least 36 inches high and 36 inches wide?</li>



<li class="">Does that path lead to a yard or court as required by the code?</li>



<li class="">Has my jurisdiction adopted any local amendments that modify the IRC?</li>
</ul>

<p class="wp-block-paragraph">Before grabbing a tape measure, the first question isn&#8217;t how big the window is. It&#8217;s whether <strong>IRC Section R310</strong> requires an emergency escape and rescue opening in the first place.</p>



<p class="wp-block-paragraph">The International Residential Code doesn&#8217;t regulate the overall size of a bedroom window. It regulates whether a room has a compliant <strong>Emergency Escape and Rescue Opening (EERO)</strong> and whether that opening meets the minimum requirements of Section R310.</p>



<p class="wp-block-paragraph">Those aren&#8217;t the same thing.</p>

<h2 class="wp-block-heading">Step 1 – Does Section R310 Even Apply?</h2>



<p class="wp-block-paragraph">Understanding these bedroom egress window requirements starts with determining whether IRC Section R310 applies.</p>



<p class="wp-block-paragraph">Generally, the IRC requires an emergency escape and rescue opening in:</p>



<ul class="wp-block-list">
<li class="">Every sleeping room. </li>



<li class="">Habitable attics. </li>



<li class="">Basements.</li>
</ul>



<p class="wp-block-paragraph">Where a basement contains one or more sleeping rooms, <strong>each sleeping room</strong> must also have its own emergency escape and rescue opening.</p>



<p class="wp-block-paragraph">The required opening must open directly to a public way, or to a yard or court that complies with Section R310.</p>



<p class="wp-block-paragraph">That&#8217;s where the analysis starts—not with a tape measure.</p>

<h2 class="wp-block-heading">Step 2 – What Counts as an Emergency Escape and Rescue Opening?</h2>



<p class="wp-block-paragraph">Most people search for <strong>bedroom egress windows</strong>, but the IRC actually uses the term <strong>Emergency Escape and Rescue Opening (EERO).</strong></p>



<p class="wp-block-paragraph">In most homes, that opening is a window. The IRC also permits a <strong>side-hinged door or a sliding door</strong> to serve as the required emergency escape and rescue opening where applicable.</p>



<p class="wp-block-paragraph">For this article, we&#8217;ll focus on the most common situation—a bedroom window.</p>

<h2 class="wp-block-heading">Step 3 – What Actually Makes a Bedroom Egress Window Code Compliant?</h2>



<p class="wp-block-paragraph">This is where many people get tripped up.</p>



<p class="wp-block-paragraph">The code does <strong>not</strong> measure:</p>



<ul class="wp-block-list">
<li class="">Rough opening</li>



<li class="">Window frame size</li>



<li class="">Glass size</li>



<li class="">Manufacturer&#8217;s listed window dimensions</li>
</ul>



<p class="wp-block-paragraph">The IRC measures the <strong>net clear opening</strong>.</p>



<p class="wp-block-paragraph">That&#8217;s the actual unobstructed opening available after the window has been opened normally.</p>



<p class="wp-block-paragraph">For a typical emergency escape and rescue window, the IRC requires:</p>



<ul class="wp-block-list">
<li class="">A minimum <strong>net clear opening area</strong> of <strong>5.7 square feet</strong>.</li>



<li class="">A minimum <strong>net clear opening area</strong> of <strong>5.0 square feet</strong> for grade-floor openings.</li>



<li class="">A minimum <strong>clear opening height</strong> of <strong>24 inches</strong>.</li>



<li class="">A minimum <strong>clear opening width</strong> of <strong>20 inches</strong>.</li>



<li class="">The bottom of the clear opening no more than <strong>44 inches above the finished floor</strong>.</li>



<li class="">The opening must result from the <strong>normal operation</strong> of the window.</li>



<li class="">The window must operate from the inside <strong>without keys, tools, or special knowledge</strong>.</li>
</ul>



<p class="wp-block-paragraph">Every one of those requirements must be satisfied.</p>



<p class="wp-block-paragraph">Meeting one requirement doesn&#8217;t satisfy the others.</p>

<h2 class="wp-block-heading">Code Reality Check</h2>



<p class="wp-block-paragraph">This is one of the biggest misunderstandings surrounding bedroom egress windows.</p>



<p class="wp-block-paragraph">Many people read the code and think:</p>

<p class="wp-block-paragraph"><strong>24-inch minimum height</strong></p>



<p class="wp-block-paragraph"><strong>20-inch minimum width</strong></p>



<p class="wp-block-paragraph">&#8220;I&#8217;m good.&#8221;</p>
</blockquote>



<p class="wp-block-paragraph">Not necessarily.</p>



<p class="wp-block-paragraph">Multiply those minimum dimensions:</p>



<p class="wp-block-paragraph"><strong>24 × 20 = 480 square inches</strong></p>



<p class="wp-block-paragraph">Now convert square inches to square feet:</p>



<p class="wp-block-paragraph"><strong>480 ÷ 144 = 3.33 square feet</strong></p>



<p class="wp-block-paragraph">The IRC requires:</p>



<ul class="wp-block-list">
<li class=""><strong>5.7 square feet</strong>, or</li>



<li class=""><strong>5.0 square feet</strong> for grade-floor openings.</li>
</ul>



<p class="wp-block-paragraph">That means a window meeting only the minimum height and minimum width requirements <strong>would still fall well short of the required opening area.</strong></p>



<p class="wp-block-paragraph">The code requires <strong>all</strong> of the minimum dimensions to be met—not just one or two.</p>

<h2 class="wp-block-heading">How Do You Measure Net Clear Opening?</h2>

<p class="wp-block-paragraph">For example, suppose the clear opening measures:</p>

<li class=""><strong>28 inches wide</strong></li>
</ul>



<p class="wp-block-paragraph">Multiply the dimensions:</p>



<p class="wp-block-paragraph"><strong>30 × 28 = 840 square inches</strong></p>



<p class="wp-block-paragraph">Now divide by <strong>144</strong> to convert square inches to square feet:</p>



<p class="wp-block-paragraph"><strong>840 ÷ 144 = 5.83 square feet</strong></p>
